Got myself a new job. I gave notice last week whilst at an event in California, and said I will work that week and this week. and take two weeks off as annual leave. Anyway, despite the chairman still not making an announcement (Ive told everyone myself instead), I'm in a quandary.

Can I start my new job whilst on annual leave or not?
 
Some company's will put you on gardening leave and prohibit you from joining other companies while you are under contract to them and being paid by them. This is especially the case i the financial services industry where you may be privvy to sensitive information. Others would make you work all of your notice period and then pay you the owed holiday pay.
Whether you can start a new job whilst legally working for someone else, i dunno but you can almost guarantee your present company would not like it!
 
Your current employer will not release your P45 until your notice period has expired, however if you spoke to them as said that you would be willing to forgo the two weeks leave due and terminate after the two weeks they may be ok with it.

I'm sure Paul won't give up his leave entitlement but No P45 is not a reason not to start a new employer though is it? Surely he could go on some emergency tax band until the P45 shows up.

That's true enough about the P45 I've changed jobs a couple of times and my P45 has followed after I've started.
 
I'm about to do something similar - I don't think anyone gives a **** to be honest Naps. It doesn't cost either party any more money and it's not illegal.

you need to check your contract
its isstandard practice for the contract to say something to the effect of you can not take up any other form of employment without the companys express permission . Normally this is to stop you working elsewhere nights/weekends which could affect your ability to work for your current employer. However at the same time it will stop you working at your new job whilst still being employed.

I thought it was OK to have 2 jobs these days, but you'd be on basic rate tax for whichever was considered to be your 'main job'.
 
As has been pointed out, depends on your contract. I was stopped from starting a new job early under the same circumstances once. I was headhunted fom my job as a broker to re-join my old bank in a management role. I asked if I could start my new job whilst technically on leave from my old one but my boss didn't let me - instead he immediately put me on gardening leave for the two weeks I was atually going to work of my leave, which was nice :clap:

I don't think that's necessarily true.

It's quite common for your P45 to follow a while after you actually start. If you're on leave (which you're entitled to be) then I don't see why you can't just start your new job. Assuming you're payed PAYE then your tax will just go onto an emergency code until you get your P45 and then it'll all come out in the wash.

Incidentally, I'm sure I posted about this exact problem with Mrs Pubey 6 months ago, the consensus then was that it was fine to start.
