Southend United face yet ANOTHER winding up petition after reportedly withholding £200,000 from their November and December PAYE submissions to the taxman.

In November, the Blues narrowly avoided going into administration following the payment of £2.1m owed to Her Majesty's Revenue and Customs (HMRC). But having gone through the figures again, Shrimpers' chairman Ron Martin has told the Guardian newspaper that the Blues actually overpaid HMRC to the tune of £200k. The HMRC say that's not the case and have taken action to recoup the money outstanding from Nov & Dec.

So, in other words, there's a dispute that RM has already informed the supporters of. RM isn't stupid, he's proven himself to be quite an astute businessman (albeit, quite a reckless one) and in his words his team of lawyers have assessed the tax issue.

As stupid as it may be to fight the HMRC, I agree that if there's evidence that we might have overpaid to the tune of £200k, then it's right to fight it. The way that the matter was rushed through, it isn't beyond the realms of possibility that a mistake was made...

But will he prove to be an astute Football Chairman - all will become clear when the Blues are happily playing in a gleaming FF, debt free.

Southend are in dispute with the tax authority about an alleged debt and face being wound up.

Southend United have accused Her Majesty's Revenue & Customs of distributing winding-up petitions to "like confetti" after becoming the latest club in the taxman's crosshairs. Southend have joined Portsmouth, Notts County, Cardiff City and Plymouth Argyle in being called to court to settle their tax debt or face being wound up.

The club's chairman, Ron Martin, has hit back with his own threat of legal action over the petition, which was received only two months after a £2.1m debt to HMRC was settled by the Roots Hall club. That payment was made after Sainsbury's, which is hoping to develop a supermarket on the club's stadium site once they move to a new ground on Fossetts Farm, provided a loan to Southend's parent company. But after going back over the figures, Southend are now disputing the £2.1m tax debt, claiming they have overpaid by more than £200,000.

The club have withheld the £200,000 from their November and December PAYE submissions, prompting the taxman's latest action. "HMRC appear to be sending out winding-up petitions against football clubs like confetti," Martin said. "The club may now need to apply to the court for an injunction against HMRC." HMRC has indeed become more aggressive in its dealings with debtors after it lost its protected creditor's status, meaning that once football debts have been settled in full in insolvency cases, the taxman must wait in a queue alongside all other creditors. HMRC refused to discuss the specific case at Southend, but a spokeswoman said: "We do not take these steps lightly."
 
If we gotta pay £200,000, we may aswell use some of the money liverpool gave us for our youngster Ngoo. Specially as he weren't even in our 1st team. Bad news though, i don't want anything or any news about money problems ha, heard enough of it as we just about avoided going into administration.

I can't believe we hadn't thought of using that earlier, you know... Perhaps you should offer your services as some kind of financial advisor.
 
We held back £200,000 from December's payment and then had to borrow £60,000 from the Trust. Makes me wonder if we didn't have the £200,000 in the first place.
 
Oh dear some people are struggling to understand!

We are holding back the money to spite the HMRC as Ron believes they owe US money.

If you mean the £250,000 that has been quoted, we only get that if he plays in the 1st team. I have not seen the amount we got up front published anywhere.

I guess the real question is

Did Ron factor all this is when we got the loan from Sainsbury’s?

IE did he borrow on the basis that the revenue figure was correct , which could mean that if the revenue agree they are wrong we have got £200,000 in cash to play with

or
Did he borrow knowing he was going to withhold the £200,000 PAYE in which case we could be in the brown stuff if he is wrong.

Joy .................... memories of the Jobson litigation era. Well lets hope Ron has more luck in the courts than Vic. Jobson's record in the courts reads like Dick Bate's record on the field.
 
The only trouble is that HMRC are the obvious experts in these tax matters.
Who would you put your money on being right, HMRC or Ron's advisors.
