So presumably you'd have preferred him to have shut the Club down rather than attempt to keep running it with insufficient cash?
I dont presume anything when it comes to "Rons" dealings with the club finances and no of course I would not like to see the club go to the wall but what about the people who are owed money by the club, is it right that they should suffer because he has mismanaged the club finances? If you have no money and then ask someone to fit you a new kitchen on the pretex of knowing full well that you cannot pay him at the end of it then there is something very wrong about that. What about the staff and small businesses who are owed money by the club, what happens to them? If you continue to rob "Peter to pay Paul" then you are on very borrowed time. Personally I cannot see a way out of the dire mess we are in and I agree with you when you say that Rons handled this mess horribly. He still spins things only now supporters are alot wiser to what is really happening at the club.
 
I'm not defending Ron at all believe me BUT if we's have gone in to admin as some wished, the creditors might get as little as 6p in the £ like Dundee FC creditors are getting. Now that's not right either. The answer is of course that clubs need to start being run as businesses. I doubt if more than a handful follow this model. They are all more or dysfunctional. I even heard that now Lincoln are going above their budget.
It'll all end in tears for all of them. It just cannot continue.
 
But Martin created this debt we owe by sacking Tilly and putting him on gardening leave. If we can't afford the compensation, we shouldn't have sacked Tilly. We can't just turf players out without going through the right motions, so why the manager? more bad management decisions.
 
I may be wrong but my reading of the law is that you can't get prosecuted as such but you can be disqualified as a Director - but for that to happen there needs to be a complaint made by a Liquidater so it's too late for the company itself. I'm happy to be corrected if someone knows differently.
Beefy, it would be covered by Fraudulent Trading under s. 993 Companies Act 2006 which is very rarely used as the burden of proof on "the intent to defraud" is difficult, however does carry up to 10 years as a penalty.

Wrongful Trading is the lesser charge which as far as I'm aware doesn't carry a punitive penalty but is still an offence in law but is more compensatory legislation under s. 214 Companies Act 1986.

Unlikely as either are they do exist.
