I wonder if there is a consideration to refer to independent sports arbitration? I have posted previously that I don't think the 'appeal' was ever Rat driven, he may have caused it but was never going to be that interested in getting them back! If the Club do go down a further appeals process, it's going to cost money so begs the question who pays ? potential new owners ? Kind benefactor? Only time will tell I suppose.

We don't even know who heard the first appeal. Somewhere in the process it would be heard by a three person panel of independent legal practitioners. That's where it would have the greatest chance og success. Maybe thats happened already, maybe not.
 
The main issue with the embargo and points deduction is that they don’t hurt the villain (Ron) but do hurt all the victims (fans, players, staff)… The sanctions regime assumes owners give a toss about the football issues. Ron doesn’t - he wants money from development, club or no club, and couldn’t give a monkeys about the footballing harm done by the embargo and points deduction.
 
Embarrassing that this even went to appeal. The NL said pay you debts or you’ll lose points, Martin didn’t pay up and they had 10 points deducted. On what grounds did they think they might actually win an appeal & not in the process of losing, incur further costs and even more debt.

Joke of a decision to press on with this as our lawyer CEO must have been aware 🤔

I believe there isn’t any route to CAS but technically the matter could go to Arbitration such Arbitration would be conducted by in house arbitrators and as ruled by the High Court in the Man City case it has been ruled that the set process is independent

Following that there is a route to take the matter to the High Court but not because of any imposed penalty but on a point of law.

I would imagine the written reasons will be published I think it will be wise to wait, as I suspect the club are doing, until those we see that document but I personally suspect the appeal was more to try to stop further penalties coming down the line

Timelines would suggest to me that the appeal has indeed been dealt with as I say elsewhere the written reasons will be issued idc . We will have to wait and see what if anything happens going forward but the “ confirmation “ that the league were within its rules when imposing the sanction based on that pre season statement for me suggests that more point deductions are likely

Trouble is, the club have been punished for a year for not paying the HMRC with an embargo. To deduct 10 points does seem like double jeapordy
TL is a lawyer so I guess he has been through it with a fine tooth comb and felt we had a case
Whilst I agree with this sentiment, unfortunately it could not have been clearer when our licence for this season was finally issued.
 
They hired the same football lawyer who got Manc City off their FFP charge.
The basis of the appeal was that the VL changed their own rules to enable the points deduction (as well as the embargo) after a cut off date for rule changes.

Man Cities lawyer in such matters is Lord Pannick who charges close to £10k an hour so I very very much doubt SUFC would be able to pay his fees which most likely would be several multiples of that £10k

The NL haven’t changed their rules the deduction clearly has been made in accord with published and agreed rules. The question is hav they exceeded those rules.
