Breaking News Winding up petition update

The Club announced yesterday that the Winding Up Petition presented by Charterhouse Commercial Finance plc was adjourned until 11th August 2010.

The reason for this was that at the Court hearing held on 8 July 2010 the Judge made an order that the hearing should be postponed until 2 August 2010.

By issuing this order it meant that the Petition presented by Charterhouse could not technically be heard.

Funds had been deposited for payment of the Revenue debt and also for the amount due to Charterhouse.

The hearing yesterday was attended by Geoffrey King, the Chief Executive and Nigel Brunning the Finance Director as Mr Martin, the Chairman is away.

He does however maintain regular contact with the office dealing with matters that concern him whilst away.

But I thought it was Charterhouse who called for an adjournment, not the registrar.

Annoyingly there appears to have been a shortage of press coverage of this case, unlike the one last week.

To be honest, I presumed last week that this case was not now going to be heard, but you would have thought that if that was the case everyone would have known going into yesterday (which maybe explains why journalists weren't there). It looks like the Club certainly expected a formal hearing yesterday.

A statement should actually explain things.
I think we need another few video interviews. That would be interesting.

Why did they turn up to court yesterday and why were the funds in place if that was the case?

Can two WUO cases not be active at the same time then?

I think this means that as this was a Winding Up petition, it could not technically proceed whilst the preceeding Administration petition is, in effect, pending. What i think is being said is that funds have been lodged to satisfy both actions but neither can be dismissed until the 2nd August hearing. That would give us 4 days to build a team for the Stockport game!

This statement is very good. It's informative and has clearly explained why the court case was adjourned.


The trouble is, why not put it out yesterday. Everyone was in uproar, lots of theories about why it was adjourned, which added to the frenzy and anger, none of them right by the way. The swear filter almost went into meltdown.
It really did look like the ship was sinking fast whilst the captain was not on board.

Still a moot point as players are signing, training and playing friendlies as they normally would. Its actually a perfect time (if there is one!) to be in this situation.

Hopefully, come August 2nd-11th, embargo gets lifted, all the players Sturrock has 'signed' become a formality and we carry on as usual.
